A Associação Nacional dos Profissionais Liberais, ANPL, assume-se em Portugal como a voz interprofissional de defesa e promoção dos profissionais liberais, freelancers e consultores, entendidos como os “detentores de qualificações de natureza intelectual, incluindo aquelas de índole artística e cultural, promovendo a sua responsabilidade, autonomia e independência no superior interesse dos consumidores e da comunidade em geral”.

A nossa Reflexão é que a organização do trabalho está a sofrer alterações profundas e os profissionais liberais e equiparados, freelancers e consultores, assumirão um papel ainda mais relevante nas novas realidades que se vão afirmando.

No Espaço Económico Europeu, um em cada seis trabalhadores por conta própria exerce a sua atividade profissional num setor relacionado com as profissões liberais e a tendência é para aumentar. Em Portugal, apesar de ultrapassarem já 400.000 profissionais regulamentados e mais de 200.000 exercendo atividades profissionais qualificadas, mas não regulamentadas, vemos os profissionais liberais sem representação e defesa plena dos seus interesses nas vertentes económica, fiscal e proteção social.

É tempo de enfrentar e alterar esta situação. Apenas quando forem convenientemente ouvidos e reconhecidos, se ajudará a mitigar a tendência de proletarização e degradação remuneratória destes profissionais e suas consequências, tais como a afetação da qualidade na prestação dos respetivos serviços como freelancers e nas empresas.

Assim, começando pelos alicerces, é essencial a concretização do Estatuto do Profissional Liberal, para que em seu torno se consolide um edifício legislativo e regulamentar europeu e nacional que permita integrar, valorizar e enquadrar estes profissionais.

Um estatuto que reconheça nos profissionais liberais e equiparados uma forma de exercício distinta, não apenas pela formação e qualificações específicas, mas sobretudo pela autonomia técnica e independência, fundamentadas numa ética profissional e corporate bem como das organizações onde se inserem, em muitas vertentes uma ética interdisciplinar, orientada para o superior interesse dos consumidores e da comunidade em geral.

Um Estatuto que integre e contemple aspetos essenciais tais como, de entre outros:

  • garantia de equidade na fiscalidade aplicável
  • proteção social adequada no desemprego e subemprego
  • a existência de seguros de responsabilidade civil e profissionais, de assistência na doença e acidentes de trabalho
  • o apoio à parentalidade
  • a especificidade na reforma e outras pensões
  • o equilíbrio entre a vida profissional e familiar
  • acesso a formação contínua e pós-graduada
  • defesa da propriedade intelectual
  • sustentabilidade e proteção do ambiente
  • aquisição e consolidação de competências digitais
  • integração e reconhecimento das qualificações de migrantes
  • e por fim reconhecimento de novas profissões e atividades bem como de emergentes formas de trabalho

Observado este quadro de requisitos básicos, estaremos em condições de acomodar neste Estatuto, não apenas aqueles que exercem as clássicas profissões liberais, algumas delas organizadas em associações profissionais públicas e privadas, mas também um conjunto de outros profissionais que têm vindo a afirmar a relevância das suas atividades na economia e em diversos setores e áreas do conhecimento, consultores, freelancers e nómadas digitais.

Recorde-se que as  associações profissionais que  regulam em certos países  algumas vertentes  relativos às profissões particulares nelas organizadas, deparam-se com limitações impostas por legislação concorrencial diversa, europeia e nacional no que respeita à abordagem de importantes aspetos que afetam os seus profissionais: em particular o impedimento de exercerem ou participarem em atividades de natureza sindical ou que se relacionem com a regulação das atividades  económicas dos seus membros.

Ora, uma parte importante dos desafios e problemas que afetam os profissionais liberais são precisamente relacionados com estas áreas “proibidas”, por exemplo, modalidades de contratação, questões salariais ou de honorários.

Por outro lado, os sindicatos não incorporam em Portugal o conceito de profissão liberal. Ora essa omissão contribui também, adicionalmente para o vazio social decorrente de deixar sem voz variadas centenas de milhares de profissionais liberais.

Existe em Portugal e em muitos países europeus um tratamento diferente e profundamente injusto entre os trabalhadores dependentes e os profissionais liberais. É essencial para os profissionais liberais a concretização de um Estatuto próprio. Para que uns não continuem a ser “mais iguais” que outros.

A ANPL é uma estrutura que tem o propósito de ajudar a preencher esta lacuna, disponível para estabelecer parcerias a nível nacional, europeu e global, assim contribuindo para dar voz aos profissionais liberais.

Let’s give the Liberal Professionals a voice

There is a different and deeply unfair treatment in Portugal and many European countries between employees and self-employed professionals. It is essential for liberal professionals to implement their own Statute. So that some don’t remain “more equal” than others.

The National Association of Liberal Professionals, ANPL, is assumed in Portugal as the only interprofessional voice for the defense and promotion of liberal professionals, freelancers and consultants, understood as the “holders of qualifications of an intellectual nature, including those of artistic and cultural, promoting their responsibility, autonomy and independence in the best interests of consumers and the community in general”.

Our reflection is as follows:

The organization of work is undergoing profound changes. Liberal professionals and alike, freelancers and consultants, will take an even more relevant role in the new realities that are affirming themselves.

In the European Economic Area, one in six self-employed workers works in a sector related to the liberal professions, and the trend is to increase.

In Portugal, despite the fact that there are already over 400,000 regulated professionals and more than 200,000 exercising qualified but unregulated professional activities, we see self-employed professionals without proper representation and defense of their interests in the economic, fiscal and social protection areas.

It is time to face and change this situation.

Only when they are properly heard and recognized, will it help to mitigate the tendency of proletarianization and remunerative degradation of these professionals and their consequences, such as the affectation of the quality in the provision of the respective services as freelancers as well in companies and organizations.

Thus, starting with the foundations, it is essential to implement the Statute of the Liberal Professional, so that around it a European and national legislative and regulatory building is consolidated allowing the integration, valorization and framing of these professionals.

A statute that recognizes in liberal and equivalent professionals a different form of practice, not only by specific training and qualifications, but above all by technical autonomy and independence, based on professional, corporate and organizations ethics, in many aspects an interdisciplinary ethics, oriented to the best interests of consumers and the community in general.

A Statute that integrates and contemplates essential aspects such as, among others:

  • guarantee of equity in the applicable taxation
  • adequate social protection in unemployment and underemployment
  • the existence of civil and professional liability insurance, illness assistance and accidents at work
  • parenting support
  • specificity in retirement and other pensions
  • work life balance
  • access to continuous and postgraduate training
  • intellectual property defense
  • sustainability and environmental protection
  • acquisition and consolidation of digital skills
  • integration and recognition of migrant’s qualifications
  • and finally, recognition of new professions and activities as well as emerging forms of work

Having observed this framework of basic requirements, we will be able to accommodate in this Statute, not only those who exercise the classic liberal professions, some of them organized in public and private professional associations, but also a set of other professionals who have been affirming the relevance of their activities in the economy and in various sectors and areas of knowledge, consultants, freelancers and digital nomads.

It should be recalled that the professional associations regulating in several countries specific aspects relating to the particular professions organized in them are faced with limitations imposed by different European and competition legislation, with regard to the approach of important aspects affecting their professionals:

in particular the impediment to engage in or participate in trade union activities or which relate to the regulation of the economic activities of its members.

However, an important part of the challenges and problems that affect liberal professionals are precisely related to these “prohibited” areas, for example, hiring modalities, wage or fee issues.

On the other hand, trade unions do not incorporate the concept of liberal profession in Portugal. Now, this omission also contributes, in addition to the social emptiness resulting from leaving hundreds of thousands of professionals without a voice.

The ANPL is a structure that aims to help fill this gap, available to establish partnerships at national, European and global level, thus contributing to give voice to liberal professionals.
